Before you use this website and share your personal data with us, please read this document carefully, as you hereinafter assent to its contents and binding nature.

1. Scope of the Privacy Policy

1.1 As a company, we value the security and privacy of the personal data of our users and visitors. Personal data means information relating to an identified or identifiable natural person.

1.2 This Privacy Policy applies to the personal data that Nailed Technologies Inc. (“Nailed Technologies,” “Shifting,” “we,” “us,” or “our”) may collect from visitors to the Shifting website located at shiftingstaff.com (the “Website”).

1.3 Please read this Privacy Policy carefully before you use the Website or submit any information to us, including through our beta access request form. By using the Website, you consent to our collecting, using, disclosing, and handling your information as described in this Privacy Policy.

1.4 This Privacy Policy applies only to the Website at this time. The Shifting platform is not yet active: user accounts, shift postings, and the other platform features described on the Website are not yet available. Once the Shifting platform becomes active, we intend to publish a separate or expanded privacy policy governing the collection and use of personal data in connection with platform accounts and platform use, including identity verification, credential information, and payment information.

1.5 You should not access or use the Website if: (a) you have any concerns about providing information to us or having such information processed and stored as described in this Privacy Policy; or (b) you do not agree with the provisions of this Privacy Policy.

1.6 The Website may contain links to other websites, including the Apple App Store and Google Play. This Privacy Policy applies only to the Website, and we are not responsible for the privacy practices or content of any linked third-party websites.

2. Policy Updates

2.1 We regularly review this Privacy Policy and reserve the right to update it at our own discretion. Updates will be posted on this page. Your continued access to and use of the Website constitutes your acceptance of those changes. This version was last updated on August 28, 2026.

3. Information We Collect

3.1 Information You Submit

3.1.1 When you submit a request for beta access to the Shifting platform through the form on the Website, we collect your first name, last name, email address, and whether you are requesting access as an employer or as a caregiver (healthcare professional).

3.1.2 We do not review or verify the validity, accuracy, or completeness of the information you provide. We encourage you to ensure that the information you submit is accurate, complete, and current.

3.2 Automatically Collected Information

3.2.1 We use Google Analytics to collect aggregate information about how visitors use the Website, such as pages visited and general usage patterns. This is described further in Section 5 (Analytics) below.

3.3 Information from third parties

We may receive your personal information from other platforms to which you have previously granted the right to store, use and share your personal information.

4. Usage of the Collected Information

4.1 We use the information collected through the beta access request form solely to manage our beta waitlist, including to review requests and to contact you regarding beta access to the Shifting platform.

4.2 We do not use the information you submit for targeted advertising, and we do NOT sell, rent, or share this information with third parties for advertising or marketing purposes.

4.3 We will use your personal information only for the purposes described in this Privacy Policy, unless we reasonably determine that we need to use it for another purpose compatible with the original purpose. If we need to use your information for an unrelated purpose, we will notify you and explain the applicable legal basis for doing so.

5. Analytics

5.1 We use Google Analytics to collect aggregate, de-identified data regarding use of the Website, such as pages visited and general browsing behavior. This helps us understand how visitors use the Website and improve it over time.

5.2 We do not currently use cookies, pixel tags, or similar technologies for advertising or remarketing purposes, and we do not currently share Website usage data with third parties for advertising purposes.

5.3 A “cookie” is a small file stored on your device that a website may use to remember information about your visit. Google Analytics may use cookies to collect the usage information described above. If you do not want cookies placed on your device, most web browsers permit you to limit or block cookies; please note that doing so may affect the functionality of the Website.

6. How We Share Your Information

6.1 We will not share, transfer, sell, trade, rent any of your personal data without your permission, except for the cases stipulated by this Privacy Policy or required by law.

6.2 We may disclose personal information to law enforcement bodies and government agencies and officials if we believe in good faith that it is absolutely necessary or appropriate to respond to a subpoena, court order, or other binding legal processes, comply with laws, report suspected illegal activity or violation of our terms and policies, or it is required in any other cases stipulated by the applicable laws.

6.3 If we undergo a merger, acquisition, financing, or sale of assets, information we have collected through the Website may be transferred as part of that transaction.

7. Data Storage and Security

7.1 We use AWS to store information collected through the Website. The Website’s front end is hosted using AWS CloudFront and Amazon S3, and information submitted through the beta access request form is stored in Amazon DynamoDB, in the AWS US East region.

7.2 Access to stored data is restricted to authorized personnel only.

7.3 We implement reasonable administrative and technical safeguards designed to protect your information from unauthorized access, use, or disclosure. Nevertheless, we cannot warrant the absolute security of any information you provide to us.

8. Data Retention

8.1 We intend to retain information collected through the beta access request form for up to twelve (12) months, including for individuals who do not ultimately receive or use platform access, unless a longer retention period is required by applicable law. We may revise our retention practices as the Shifting platform develops.

9. User Rights

9.1 You may contact us to request that we correct any inaccurate personal information we hold about you.

9.2 You can request us to stop processing your personal data or, if you are a resident of California or Virginia or another state with similar data protection laws, to erase your personal data.

9.3 At this stage, deletion of personal information submitted through the Website is handled internally by authorized personnel, and self-service deletion is not currently available to users. You may still contact us using the information in the section [9.5] below, and we will consider requests regarding your information on a case-by-case basis.

9.4 You may opt out of further communications regarding beta access at any time by contacting us using the information in the section [9.5] below.

We will investigate and make every reasonable effort to honor your wish to exercise your rights as quickly as possible and, in any event, within the timescales provided by data protection laws.

10. Children's Privacy

10.1 The Website is intended only for persons who are at least eighteen (18) years old. We do not knowingly collect personal information from children under the age of 18. If we learn that we have collected personal information from a child under 18, we will delete that information as quickly as possible.
